W7 - Forthcoming Changes to the Law on Preventing Illegal Working

The Government intends to change section 8 of the Asylum and Immigration Act 1996, the law for all United Kingdom employers on preventing the employment of illegal workers. These changes will come into affect on 1 May 2004.

You may already be aware that ten new countries will be joining the European Union on 1 May 2004. Nationals from all of these countries will be free to come and work in the United Kingdom from this date. Nationals from eight of these new Member States who find a job in the United Kingdom will be required to apply to register with the Home Office under the new Worker's Registration Scheme.

The Government will be producing more detailed guidance for employers on how to comply with the law on preventing illegal working. This will provide detailed technical information on the section 8 changes. This longer guidance will be made available from 19 April 2004, from the Home Office website: www.ind.homeoffice.gov.uk/default.asp?pageid=17

You will also be able to obtain this more detailed guidance, from early May 2004 by calling the Employers' Helpline on 0845 010 6677. You should also call the Employers' Helpline if you have any further queries about the forthcoming changes to the law and what is required of you in order to comply with the new arrangements.
